1. Acceptance of Terms

By accessing and using the Kairo Travel mobile application ("the App"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Kairo Travel is a mobile application provided by Traverse Path Ltd that provides AI-powered travel planning, recommendations, and itinerary management services. The App uses artificial intelligence to help you discover destinations, plan trips, and manage your travel experiences.

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account with others

4. AI Services and Limitations

We strive to provide accurate AI-generated content, but:

• AI recommendations may contain errors or outdated information
• We do not guarantee the accuracy of AI-generated itineraries
• You are responsible for verifying travel requirements, visa information, and safety advisories
• Weather conditions, local events, and circumstances may affect your travel plans

5. Usage Limits and Service Tiers

To ensure fair access for all users, we implement usage limits based on your service tier:

5.1 Free Tier

• 2 AI travel plan generations per day
• 10 AI chat conversations per day
• Maximum 7 days per single-city trip
• Maximum 5 cities per multi-city trip
• Maximum 14 total days across all cities in multi-city trips
• Standard place recommendations

5.2 Premium Tier (Subscription)

• 10 AI travel plan generations per day
• 50 AI chat conversations per day
• Maximum 21 days per single-city trip
• Maximum 10 cities per multi-city trip
• Maximum 25 total days across all cities in multi-city trips
• Enhanced place details with ratings, prices, hours, and official websites (powered by Google Places API)
• Priority customer support

5.3 Limit Enforcement

• Daily quotas reset at midnight UTC
• Trip duration and city count limits are enforced when creating plans
• Requests for trips exceeding your tier limits will be rejected with an upgrade prompt
• Excessive abuse or attempts to bypass limits may result in temporary suspension or account termination

6. Payment and Subscriptions

6.1 Subscription Plans

We offer the following Premium subscription plans:

• Monthly Plan: £0.99 per month, billed monthly
• Annual Plan: £9.99 per year, billed annually (saves approximately 17% compared to monthly)

6.2 Payment Processing

All payments are processed securely through Apple's App Store (for iOS) or Google Play Store (for Android) in-app purchase systems. By subscribing, you agree to Apple's or Google's respective terms and conditions. We do not store your payment card information on our servers.

6.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged the then-current subscription rate.

6.4 Free Trial

New subscribers receive a 7-day free trial period. During the trial:

• You have full access to all Premium features
• No payment is collected
• You can cancel anytime during the trial without being charged
• After 7 days, your subscription automatically converts to a paid plan and billing begins

The free trial is available once per user account. Users who have previously subscribed are not eligible for additional free trials.

6.5 Cancellation

You may cancel your Premium subscription at any time through:

• The App settings menu (which will redirect you to the appropriate store)
• iOS: Settings → [Your Name] → Subscriptions → Kairo Travel
• Android: Google Play Store → Account → Payments & Subscriptions → Subscriptions → Kairo Travel

Cancellations take effect at the end of your current billing period. You will retain Premium access until that date.

6.6 Refunds

After the free trial period ends and billing begins, subscription fees are non-refundable. You may cancel your subscription at any time to prevent future charges, but no refunds will be provided for the current billing period.

6.7 Failed Payments

If a subscription payment fails:

• We may attempt to process payment again
• You may receive notifications about the failed payment
• If payment fails after multiple attempts, your Premium access may be downgraded to the Free tier
• Your saved data and itineraries will be preserved

6.8 Price Changes

We reserve the right to change subscription prices with 30 days' advance notice via email. Price changes will not affect your current billing period. If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect.

6.9 Taxes

Subscription prices may be subject to applicable taxes based on your location. Any required taxes will be added to your invoice and clearly displayed before payment.

7. Prohibited Activities

You agree not to:

• Use the App for any illegal purposes
• Attempt to hack, reverse engineer, or compromise the App's security
• Abuse or spam the AI services
• Scrape, copy, or redistribute AI-generated content commercially
• Impersonate others or create fake accounts
• Upload malicious content or viruses
• Harass, bully, or harm other users
• Attempt to bypass or circumvent usage limits or subscription requirements

8. Content Ownership

You retain ownership of your personal travel plans and user-generated content. By using the App, you grant us a license to use your content for:

• Providing and improving our services
• Displaying your shared posts in the community
• Training and improving our AI models (anonymized)

9. Third-Party Services

The App integrates with third-party services including Apple App Store and Google Play Store (subscription management), Google Places API (premium place details), maps, and weather services. We are not responsible for:

• Third-party service availability or accuracy
• Changes to third-party APIs or services
• Third-party terms and privacy policies
• Payment processing issues beyond our control

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:

• The App will be error-free or uninterrupted
• AI recommendations will be accurate or suitable for your needs
• Your data will never be lost (though we implement backups)
• The App will meet all your expectations
• Premium features will always be available without interruption

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Any damages arising from your use of the App
• Travel disruptions, cancellations, or losses
• Inaccurate AI recommendations or information
• Data loss or security breaches beyond our control
• Indirect, incidental, or consequential damages
• Payment processing errors or disputes
• Loss of Premium access due to payment failures

12. Modifications to Service

We reserve the right to:

• Modify or discontinue features at any time
• Change usage limits and pricing (with notice as specified in Section 6.8)
• Update these Terms of Service (changes effective upon posting)
• Suspend or terminate accounts for violations
• Modify or remove Premium benefits with reasonable notice

13. Termination

You may delete your account at any time through the App settings. We may suspend or terminate your account if you violate these terms. Upon termination:

• Your access to the App will be revoked
• Your data will be deleted in accordance with our Privacy Policy
• Saved travel plans will be permanently removed
• Active subscriptions will be cancelled (no refund for remaining period)
• You will lose access to Premium features immediately upon voluntary account deletion

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved through binding arbitration in accordance with the Arbitration Act 1996.

16. Severability

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Traverse Path Ltd regarding the use of the App.
